Refund policy
REFUND, RETURNS, AND CANCELLATION POLICY
1. Definitions and Interpretation. For the purposes of this Refund, Returns, and Cancellation Policy (hereinafter, the "Policy"), the following capitalized terms shall bear the meanings ascribed to them: "Company," "we," "us," or "our" shall refer to the operator of this online retail establishment and its respective successors, assigns, affiliates, officers, directors, employees, and agents; "Customer," "you," or "your" shall refer to the natural or legal person who placed the applicable Order; "Order" shall mean any purchase transaction consummated through the Site; "Product(s)" shall mean the goods supplied; "Return Authorization" or "RMA" shall mean the prior written authorization required hereunder; and "Guarantee Period" shall mean the ninety (90) day interval defined in Section 3. Section headings are provided for convenience only and shall not govern interpretation.
2. Scope, Acceptance, and Incorporation by Reference. By placing an Order, the Customer acknowledges, represents, and unconditionally agrees that they have read, understood, and accepted this Policy in its entirety, and that this Policy is incorporated by reference into, and forms an integral and indivisible part of, the Company's Terms of Service. This Policy shall apply to the fullest extent permitted by applicable law and shall govern all matters pertaining to returns, refunds, exchanges, and cancellations, notwithstanding any prior representation to the contrary.
3. Ninety (90) Day Satisfaction Guarantee. Subject to, and conditioned upon, the Customer's full and timely compliance with each and every term, condition, procedure, and limitation set forth in this Policy, the Company offers a ninety (90) day satisfaction guarantee, commencing on the date of delivery, pursuant to which an eligible Customer may request a refund of the purchase price actually paid for qualifying Products. The availability of such guarantee is expressly contingent upon adherence to the authorization, condition, documentation, and timing requirements enumerated below, and shall not be construed to enlarge, extend, or supplement any right beyond that expressly stated herein.
4. Return Authorization (RMA) Requirement. No return shall be accepted, processed, credited, or refunded unless and until the Customer has first contacted the Company at the address set forth in Section 14 and obtained a valid Return Authorization. Products returned without a valid RMA, or returned to an address other than that designated in the RMA instructions, may, in the Company's sole and absolute discretion, be refused, returned to sender, or rendered ineligible for any refund whatsoever. The Customer must initiate the RMA request within the Guarantee Period; requests submitted thereafter shall be deemed waived, forfeited, and time-barred.
5. Condition of Returned Products. All Products tendered for return must be accompanied by proof of purchase and a valid RMA reference, and must be returned in a condition consistent with the Company's instructions. The Company reserves the right, in its sole and absolute discretion, to assess the condition of any returned Product and to decline, reduce, or prorate any refund in respect of Products exhibiting evidence of misuse, abuse, alteration, or condition inconsistent with the represented basis for return.
6. Non-Returnable Items and Exclusions. Notwithstanding any other provision hereof, the following are excluded from return and refund eligibility to the fullest extent permitted by applicable law: (a) items designated at the point of sale as "final sale," clearance, or non-returnable; (b) items returned without prior Return Authorization; (c) items returned after the expiry of the Guarantee Period; (d) promotional items, gifts, or complimentary inclusions; and (e) any item the return of which is restricted by reason of hygiene, health, or safety considerations once unsealed, save as required by mandatory applicable law.
7. Return Shipping Costs. Except where a Product is determined by the Company to be materially defective or to have been supplied in error, the Customer shall bear sole responsibility for all costs, charges, and risks associated with the return shipment, including but not limited to postage, insurance, duties, and tracking. The Company shall not be responsible for any return consignment lost, delayed, damaged, or misdirected in transit, and the Customer is strongly advised to retain proof of dispatch and tracking.
8. Processing, Method, and Timing of Refunds. Approved refunds, where granted, shall be issued to the original method of payment, and to no other method, within a commercially reasonable period following the Company's receipt and inspection of the returned Product; any indicative processing interval communicated to the Customer is an estimate only and shall not constitute a binding obligation. The Company shall not be responsible for any delay attributable to the Customer's financial institution, card issuer, or payment processor.
9. Restocking and Partial Refunds. The Company reserves the right, in its sole and absolute discretion and to the extent permitted by applicable law, to apply a reasonable restocking deduction or to issue a partial refund in respect of Products returned in a condition warranting such adjustment.
10. Cancellations. Requests to cancel or modify an Order may be accommodated only if received prior to the commencement of processing or dispatch. Once an Order has entered processing or has been tendered to a carrier, it may no longer be subject to cancellation, and the Customer's recourse, if any, shall be governed by the return procedures set forth herein.
11. Damaged or Defective Products. In the event a Product is received in a damaged or defective condition, the Customer shall notify the Company within a reasonable period following delivery and shall furnish such documentation, including photographic evidence, as the Company may reasonably require to evaluate the claim, the determination of which shall rest within the Company's reasonable discretion.
12. Chargebacks. The Customer agrees to contact the Company to resolve any dispute prior to initiating a chargeback, reversal, or payment dispute. The institution of a chargeback in circumvention of this Policy shall constitute a material breach, and the Company reserves all rights and remedies available at law or in equity in respect thereof.
13. Limitation of Liability, Indemnification, Severability, and Survival. To the fullest extent permitted by applicable law, the aggregate liability of the Company arising out of or in connection with this Policy, howsoever arising, shall not exceed the amount actually paid by the Customer for the specific Product giving rise to the claim, and in no event shall the Company be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages. If any provision hereof is held invalid or unenforceable, the remaining provisions shall continue in full force and effect, and Sections 7, 12, and 13 shall survive completion or termination of any transaction.
14. Amendment, Entire Agreement, and Contact. The Company reserves the right, at any time and in its sole discretion, to amend, modify, or restate this Policy without prior notice, with any revision effective upon publication. This Policy constitutes the entire understanding between the parties with respect to its subject matter.
